Objective and Contents of the Course

Course Objectives: The aim of this course is to teach students the fundamental principles of maritime trade law, the relevant legislation, and case law, as well as to familiarize them with applying their knowledge through practical exercises related to problems that may arise in practice.
Course Content: Introduction to Maritime Trade Law, sources of maritime trade law, definition of a ship, ship registry, ship ownership, shipowner and shipping partnership, seafarers, charter parties, documents in maritime trade law, carrier's liabilities and rights, contracts for the carriage of passengers by sea, maritime accidents, collisions and salvage, ship and cargo creditors, enforcement proceedings.

Learning Outcomes

The students who have succeeded in this course;
1) I. Can identify the fundamental sources of maritime trade law.
2) II. Can analyze the rules related to ships and her elements.
3) III. Can explain the function of the ship registry.
4) IV. Can list the real rights over a ship. Interprets the rules related to ship ownership and ship mortgages. Applies maritime trade law rules to problems concerning ship ownership and mortgages.
5) V. Identifies problems related to maritime loans and usufruct rights over a ship and interprets the rules.
6) VI. Can explain the concepts of shipowner and shipping partnership. Defines shipowner and shipping partnership. States and discusses the liabilities of the shipowner. Interprets the rules related to shipowner and shipping partnership. Resolves issues related to shipowner and shipping partnership.
7) VII. Can list the crew of a ship. Explains the duties, authorities, and responsibilities of the master.
8) VIII. Can explain the fundamental concepts related to charter parties and their elements. Identifies the parties and related persons of a charter party. Specifies the types of charter parties. Provides information about the performance of charter parties.
9) IX. Can explain the bill of lading. Specifies the form and content of the bill of lading. States the functions of the bill of lading. Resolves issues related to the bill of lading.
10) X. Can explain the carrier's responsibilities, rights, and the termination of charter parties. Specifies the carrier's liabilities. States the carrier's rights. Identifies issues related to the termination of charter parties.
11) XI. Deniz yoluyla yolcu taşıma sözleşmesine ilişkin deniz ticareti hukuku kurallarını analiz edebilir.
12) XII. Can explain maritime accidents. Defines collisions. Defines salvage and assistance. Identifies issues related to maritime accidents.
